What is this line for? (“WITLF,” “we,” “us,” or “our”) provides the Service to you through our website located at https://whatisthislinefor.nyc and our iOS application (collectively, the “Service”). All access and use of the Service is subject to the terms and conditions contained in these Terms of Service (as amended from time to time, these “Terms”). By accessing, browsing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you may not access, browse, or otherwise use the Service.
You may use the Service only if you are at least 13 years old and able to form a binding contract under applicable law, and only in compliance with these Terms and all applicable laws. By using the Service, you represent that you meet these requirements.
If you are under 18, you may use the Service only with the involvement of a parent or legal guardian who has reviewed and agreed to these Terms on your behalf and who is responsible for your activity on the Service.
You may not use the Service if you have previously been suspended or removed from the Service.
You can browse the Service without an account. To post, review, save lines, or use other account-based features, you must create an account and provide us with an email address. We use one-time codes for sign-in, so there is no password to set or manage. Do not share your one-time codes with anyone. You are responsible for maintaining the security of the email account you use to sign in and for all activity that occurs under your account. You may not use another person's account or permit anyone else to use yours. Notify us at hello@whatisthislinefor.nyc if you suspect unauthorized access to your account. We are not responsible for any loss arising from unauthorized use of your account.
We may send you account and security notices at the email address associated with your account.
You may delete your account at any time inside the app at Settings → Account → Delete Account. Deletion is governed by our Privacy Policy.
Except for your User Content, the Service and all materials made available through it — including software, text, graphics, logos, photographs, and the “What is this line for?” name and branding (our “Content”) — together with all intellectual property rights related to it, are the exclusive property of WITLF and its licensors. Except as expressly provided in these Terms, nothing in these Terms creates a license in or under any such intellectual property rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any of our Content. Use of our Content for any purpose not expressly permitted by these Terms is strictly prohibited.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. We reserve all rights not expressly granted.
You may choose or we may invite you to submit comments or ideas about our Service. If you send us suggestions, ideas, or other feedback about the Service (“Feedback”), you agree we may use it without restriction and without any obligation to compensate or credit you.
The Service may contain text, photos, links, and other materials, including materials you create with or submit to the Service (your “User Content”).
You are solely responsible for your User Content and the consequences of submitting it. Content you post to the Service is visible to other users. We take no responsibility for and we do not expressly or implicitly endorse, support, or guarantee the completeness, truthfulness, accuracy, or reliability of any User Content. You may encounter User Content that you find inaccurate, offensive, or otherwise objectionable, and you access such content at your own risk.
You retain ownership of your User Content. By posting User Content you grant WITLF a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (e.g., format or resize for display), create derivative works (e.g., thumbnails), publicly display, and distribute your User Content solely for the purpose of operating, providing, and promoting the Service. This license ends when you delete the User Content or your account, except for (a) content retained in anonymized form, (b) residual backup copies, and (c) copies we must keep to comply with the law or protect safety — in each case as described in our Privacy Policy.
You represent and warrant that (i) you own or have the necessary rights to your User Content, (ii) your User Content does not violate these Terms or the rights of any third party, and (iii) you have obtained the consent of any identifiable persons depicted in photos you upload, to the extent required by law.
We have no obligation to monitor or pre-screen User Content, but we may review, remove, or restrict access to any User Content at our discretion, at any time and for any reason.
You agree not to use the Service to:

You can report content or other users from within the app, and you can block other users. We review reports and may remove content or suspend or terminate accounts at our discretion. We do not guarantee any particular outcome or response time. See our Community Guidelines for how reporting and moderation work.
WITLF respects the intellectual property of others, and we ask our users to do the same. If you believe your work has been copied in a way that constitutes copyright infringement, you may notify our Designated Agent using the procedure below.
We process and investigate notices of alleged infringement and take appropriate action under the Digital Millennium Copyright Act (“DMCA”). Under Section 512(f) of the DMCA, you may be liable for damages, including costs and attorneys' fees, if you knowingly misrepresent that material is infringing.

We will terminate the accounts of users we determine to be repeat infringers.
We may suspend or terminate your account or your access to the Service at any time, with or without notice, if you violate these Terms, our Community Guidelines, or applicable law, or if we reasonably believe doing so is necessary to protect the Service or other users.
We may also modify, suspend, or discontinue the Service, or any part of it, at any time. We will not be liable to you for suspending or terminating your account or for modifying or discontinuing the Service.
You may terminate at any time by deleting your account inside the app.
Sections 3, 4 (the license to User Content, only as to copies retained per our Privacy Policy), 5, 9, 10, 11, 12, 13, and 14 survive termination.
The Service relies on third-party providers for infrastructure such as hosting, data storage, error monitoring, email delivery, maps, and push notifications. We are not responsible for the practices of these third parties, and your use of their services may be subject to their own terms and privacy policies.
If you access or download the iOS app through the Apple App Store, you acknowledge and agree that: (a) these Terms are between you and WITLF, and not with Apple; (b) WITLF, and not Apple, is solely responsible for the app and its content; (c) Apple has no obligation to provide maintenance, support, or other services with respect to the app; (d) Apple is not responsible for addressing any claims relating to the app, including product liability, legal compliance, or intellectual property claims; and (e) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You also represent that you are not located in a country subject to a U.S. Government embargo or on any U.S. Government list of prohibited or restricted parties, and you agree to comply with the applicable App Store terms when using the app.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” AND YOUR USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Content on the Service is submitted by users. We do not verify and cannot guarantee the accuracy, completeness, or timeliness of any user-submitted content. Do not rely on the Service for decisions where inaccuracy could cause harm (for example, medical, legal, or safety decisions).
We are not affiliated with, endorsed by, or sponsored by any venue, restaurant, business, or event mentioned in user content unless explicitly stated.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WITLF, ITS OWNER, OR ITS CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA RESULTING FROM YOUR USE OF THE SERVICE. WE ARE NOT LIABLE FOR ANY PERSONAL INJURY, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM YOUR INTERACTIONS WITH OTHER USERS OR YOUR VISITS TO ANY LINE, VENUE, BUSINESS, OR EVENT. THESE LIMITATIONS APPLY TO ANY THEORY OF LIABILITY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER BASIS, AND EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the foregoing limitations apply to the greatest extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for our own gross negligence or willful misconduct.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless WITLF and its owner from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your User Content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party. We may assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of that claim.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles.
If you have a dispute with us, you agree to first contact us at hello@whatisthislinefor.nyc and try to resolve it informally. If we cannot resolve the dispute within sixty (60) days, either of us may pursue the claim in court.
Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose; otherwise, it is permanently barred.
